Terms of Service

Welcome to Capital Car Hire!

Capital Car Hire and its associated Operators and Licensees are not common carriers and may refuse to carry any person(s) without providing a reason. Capital Car Hire and each Operator or Licensee are only responsible for the services they individually provide and hold no liability for the actions or services of others.

By confirming a booking, the hirer acknowledges they have read, understood, and agreed to be bound by the full Terms and Conditions.

Capital Car Hire, its Operators, and Licensees accept no liability for costs or losses—such as missed flights or travel connections—that may result from diversions, substitutions, alterations, cancellations, delays, or booking errors. It is the responsibility of the hirer to notify Capital Car Hire of any changes to their booking, as additional charges may apply.

All passengers must comply with applicable laws and regulations in the state or territory of travel and must follow instructions given by Capital Car Hire, its Operators, and Licensees.

Except as expressly provided by these Terms and Conditions, and to the extent permitted by law:

• (a) Capital Car Hire, its Operators, and Licensees shall not be held liable for any injury or death, loss or damage to personal belongings or luggage, delays, or any indirect or consequential losses resulting from negligence, omission, or any other cause related to the provision or non-provision of services; and

• (b) We accept no responsibility for inaccuracies in transport service information, including pricing.

Booking Amendments

Any amendments to confirmed bookings are subject to availability. Capital Car Hire reserves the right to apply an amendment fee, in addition to any other costs incurred as a result of changes made to the original booking.

Credit Card Surcharges & Transactions

Credit card surcharges may apply at the discretion of Capital Car Hire. By using a credit card to pay for services, the purchaser agrees to settle the full amount upon billing.

Passenger Safety

Our chauffeurs operate vehicles safely and responsibly, adhering to posted speed limits and prevailing road conditions. Chauffeurs reserve the right to deny access to any location or venue they deem unsafe for passengers or the vehicle.

Damage to Vehicle and Misconduct

Passengers are liable for any damage caused to the vehicle as a result of misconduct or inappropriate behaviour. Chauffeurs reserve the right to terminate the service if passenger behaviour compromises safety.

Booking Extensions

If the duration of the service is extended or additional stops are added, the hirer will be responsible for any resulting charges imposed by Capital Car Hire, its Operators, or Licensees.

Additional Charges

In the event of additional charges or extensions, payment must be made directly to the chauffeur before or upon completion of the service. Charges may also be applied to the hirer’s account or credit card used to secure the original booking.

Insurance

Capital Car Hire, its Operators, and Licensees maintain public liability insurance. This insurance does not cover personal travel or belongings. While reasonable care is taken to protect personal property, Capital Car Hire does not accept liability for any loss or damage. Passengers are advised to arrange adequate insurance for their possessions.

Lost Property

Capital Car Hire accepts no responsibility for personal items left in vehicles. If any property is left behind, efforts will be made to return it at the customer's expense, or items may be collected from the nearest Customer Service Centre.

Punctuality

Capital Car Hire will take all reasonable measures to ensure timely arrival. However, in the event of delays due to unforeseen circumstances, we accept no liability for any resulting inconvenience or losses.

Pets

Pets are not permitted in any Capital Car Hire vehicles unless special arrangements have been granted.

Smoking

Smoking is strictly prohibited in all Capital Car Hire vehicles in accordance with state legislation. A cleaning or penalty fee may be applied if a passenger is found smoking in the vehicle.

Seat Belts

In accordance with Australian law, all passengers must wear seat belts where fitted at all times while the vehicle is in motion.

Payment Terms

Full pre-payment is required for all bookings, including (but not limited to) weddings, school formals, sporting events, and concerts. All bookings must be secured with valid credit card details.

Subcontracting

Capital Car Hire reserves the right to engage pre-approved subcontractors—including hire car, limousine, or bus service providers—to deliver services when necessary. These third-party providers are thoroughly vetted and remain under the supervision of Capital Car Hire for the duration of the service.

Cancellation Policy

A full refund is applicable for cancellations made 𝐚𝐭 𝐥𝐞𝐚𝐬𝐭 𝟑𝟎 𝐝𝐚𝐲𝐬 𝐛𝐞𝐟𝐨𝐫𝐞 the booking.

𝟓𝟎% 𝐑𝐄𝐅𝐔𝐍𝐃:
For cancellations made between 7 and 30 days before the booking, 50% of the total booking amount will be refunded.

𝐍𝐎 𝐑𝐄𝐅𝐔𝐍𝐃:
Cancellations made 𝐥𝐞𝐬𝐬 𝐭𝐡𝐚𝐧 𝟕 𝐝𝐚𝐲𝐬 before the booking are non-refundable and will be charged 100% of the booking amount.
